Terms of Service

These Terms of Service constitute a legally binding agreement between you and Canada West Asset. Please read them carefully before using our services.

By accessing our website, creating an account, or using any Canada West Asset service, you agree to be legally bound by these Terms of Service. If you do not agree, you must immediately discontinue use of all Canada West Asset services and platforms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Canada West Asset ("Company," "we," "our," or "us") website, client portal, and all associated services (collectively, "Services"). These Terms apply to all users, including visitors, registered clients, and any other individuals or entities that interact with our platform.

By accessing or using our Services, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into a binding agreement; (c) your use of the Services does not violate any applicable law, regulation, or agreement to which you are a party; and (d) all information you provide to Canada West Asset is accurate, truthful, and complete.

2. Description of Services

Canada West Asset provides the following professional consulting and advisory services:

  • Financial asset recovery consulting and case management
  • Blockchain forensic analysis and cryptocurrency tracing
  • Legal support coordination and regulatory compliance guidance
  • Fraud investigation support and documentation preparation
  • Communication with financial institutions, law enforcement, and regulatory bodies on behalf of clients with explicit written authorization
  • Secure client portal access for case tracking, document submission, and communications

Canada West Asset does not guarantee specific recovery outcomes. The success of any recovery effort depends on numerous factors including, but not limited to, the nature of the loss, jurisdiction, cooperation of third parties, legal constraints, and availability of recoverable assets. Our role is advisory and facilitative in nature.

3. Account Registration and Security

To access certain Services, you must register for a client account. By registering, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the confidentiality of your login credentials and not share them with any third party
  • Immediately notify Canada West Asset of any unauthorized use of your account or any other security breach
  • Accept responsibility for all activities that occur under your account

Canada West Asset reserves the right to suspend or terminate accounts that: contain inaccurate information, have been inactive for an extended period, are used in violation of these Terms, or are involved in suspicious or fraudulent activity.

4. Client Obligations and Representations

As a client of Canada West Asset, you agree to the following obligations:

Truthful and Accurate Information

You must provide only truthful, accurate, and complete information regarding your case. Providing false or misleading information constitutes a material breach of these Terms and may result in immediate termination of services without refund, as well as potential legal liability.

Cooperation

You agree to cooperate fully with Canada West Asset personnel, provide requested documentation in a timely manner, and respond promptly to communications. Failure to cooperate may impair or prevent recovery efforts.

Lawful Use

You represent that you are the lawful owner of the assets you seek to recover or have legal authority to seek recovery on behalf of the rightful owner. You agree not to use Canada West Asset services for any unlawful purpose or in violation of applicable laws and regulations.

Non-Interference

You must not take any action that may interfere with, compromise, or hinder the recovery process, including independent contact with parties identified by Canada West Asset unless expressly authorized by us in writing.

5. Fees, Payment, and Refund Policy

Service fees are outlined in individual client service agreements, engagement letters, or invoices provided to you at the commencement of services. The following conditions apply to all fee arrangements:

  • All fees are denominated in U.S. dollars unless otherwise agreed in writing
  • Fees are due and payable upon presentation of an invoice unless alternative terms are agreed in writing
  • All payments are generally non-refundable, as fees are earned upon the commencement of work and allocation of resources to your case
  • Exceptions to the non-refundable policy may be made solely at Canada West Asset's discretion and must be agreed in writing
  • Canada West Asset reserves the right to suspend or terminate services for non-payment of outstanding fees
  • You are responsible for any applicable taxes, levies, or duties on fees charged

Disputed invoices must be raised in writing within 14 calendar days of invoice date. Failure to dispute an invoice within this period constitutes acceptance of the charges.

6. Confidentiality

Both parties agree to maintain the confidentiality of all information shared in connection with the engagement. Canada West Asset will treat all client case information as strictly confidential and will not disclose it to unauthorized third parties without your express written consent, except as required by law or regulatory obligation.

Clients agree not to disclose proprietary Canada West Asset methodologies, strategies, or investigative techniques shared in the course of services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Canada West Asset, its officers, directors, shareholders, employees, agents, and affiliates shall not be liable for:

  • Any failure or inability to recover lost, stolen, or fraudulently obtained assets
  • Indirect, incidental, consequential, punitive, or special damages of any kind
  • Loss of profits, business opportunities, reputation, or data
  • Damages resulting from third-party actions, inactions, or decisions beyond our control
  • Delays caused by regulatory processes, judicial proceedings, or governmental action
  • Technical failures, system outages, or interruptions to our client portal

Where liability cannot be excluded by law, our total aggregate liability shall be limited to the total fees paid by you to Canada West Asset in the 12 months preceding the event giving rise to the claim.

8. Intellectual Property

All content on the Canada West Asset website and client portal, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the exclusive property of Canada West Asset or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our platform for its intended purpose. You may not reproduce, redistribute, modify, create derivative works, or commercially exploit any content without our prior written consent.

9. Termination

Either party may terminate the service engagement with written notice. Canada West Asset reserves the right to terminate services immediately and without notice if: (a) you breach any provision of these Terms; (b) you provide false or fraudulent information; (c) your use of services threatens the integrity or security of our systems; or (d) continuation of services would violate applicable law.

Upon termination, your access to the client portal will be revoked. Fees for work completed prior to termination remain due and payable. Provisions of these Terms that by their nature should survive termination shall continue in full force and effect.

10. Governing Law, Dispute Resolution & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall first be subject to good-faith negotiation between the parties. If negotiation fails within 30 days, the parties agree to submit to binding arbitration in Wilmington, Delaware, under the rules of the American Arbitration Association (AAA). Judgment upon the arbitration award may be entered in any court of competent jurisdiction.

Nothing in this clause shall prevent either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to protect confidential information or intellectual property rights.

Canada West Asset reserves the right to modify these Terms at any time. Material changes will be communicated via email or notice on the client portal. Continued use of our Services following notification of changes constitutes acceptance of the revised Terms.
